Judge: Education Reimbursement FIFA violate law – AD.nl

Update FIFA in Germany today lost a lawsuit over the use of the training fee to be paid by clubs for acquired players who have been trained elsewhere. According to the judge, this is in breach of European law on free choice of work.

The court ruling in Bremen may have implications for the European legislation in this area and is therefore still subject to review by the national court in Germany. Clubs receive a training allowance to encourage the training of young players and prevent players just before they are allowed to sign a contract ‘free’ leave. Even with transfers then the trainer remains entitled either to a percentage of the transfer fee.

The case was brought by SV Wilhelmshaven, last summer was sentenced to relegation from the Regionalliga Nord, the fourth level in Germany. The club moved in 2007 Sergio Sagarzazu free transfer, but his former club River Plate and Atletico Excursionistas asked a training allowance of 157,500 euros together. Wilhelmshaven refused to pay and was therefore in 2011-2012 and 2012-2013 already punished with six points deduction and last summer with direct relegation. The club now hopes to return in the Regionalliga Nord and compensation.
